Agreement Information

Note: Please scroll down and carefully read all of the following information. A check box is provided at the bottom of this form, to provide your electronic signature, which indicates your agreement to the Release and Assumption of Risk, and the Terms and Conditions, herein described.

RecPlex Membership Contract Terms and Conditions

1. Membership to the RecPlex is open to the Nova Southeastern University community defined as: Students, Alumni, Faculty, Staff, NSU Affiliates, and their spouse, children, or immediate family members living in the same home. All members on the account must be aged 18 or older.
2. Members may also sponsor one non-NSU Affiliate for a one year membership.
3. Membership term is one year starting from the initial month enrolled.
4. Persons who activate their membership between the 1st and 15th of the month will be billed for the full month. Persons who activate their membership the 16th – 31st will be billed for 50% of the month.
5. Faculty/Staff who are full time and get paid biweekly via payroll deduction will have their membership billed by payroll deduction. All others will be billed via monthly credit card draft.
6. All memberships auto-renew annually. Memberships are only cancelled per written request.
7. Memberships will be automatically terminated for employees that are on payroll deduction who cease employment at NSU.
8. Request for contract termination must be given in writing to the membership office 2 weeks before the next billing cycle, which is the 1st of the next month.
9. Memberships cannot be transferred to another person.
10. Membership can be terminated or canceled by the RecPlex at any time, with or without cause and I may not be entitled to a refund of my membership upon such termination or cancellation.
11. I recognize that I share responsibility for ensuring my membership account is accurate. Any billing errors must be reported to the RecPlex in a timely fashion. The RecPlex will not refund any fees in excess of 60 days of any said error occurring.

Release and Assumption of Risk

Release: In consideration of Nova Southeastern University (NSU) allowing me to participate in the use of recreation and fitness programs and facilities, I hereby release, indemnify, and hold harmless NSU, it officers, trustees, employees, and agents from liability for personal injury, accident or illness (including death), and property loss arising out of or resulting from my participation in or observation in activities and classes, and my use of facilities, premises, or equipment and the NSU RecPlex (Recreational Complex).

Assumption of Risks: I am aware of the potential risks and dangers of the use of exercise and weight training equipment and related exercise activities taking place at the RecPlex. Some of the these activities are strenuous in nature using various muscle groups, involving quick movements, sudden change of direction, and sustained physical activity which places stress on the cardiovascular system. Specific risks vary from one activity to another, and these risks are not limited to minor injuries such as scratches, bruises, sprains, but to serious injuries such as eye injuries, back injuries, concussions, and catastrophic injuries including paralysis and death.

I understand and agree that with respect to my involvement in activities at the RecPlex, I assume all of the above mentioned risks and all risks inherent in the nature of such activities, together with all risks of injury resulting from (i) my failure to follow NSU policies relations to the RecPlex, (ii) my failure to follow instructions concerning the use of equipment, and (iii) the acts or omissions of others participating in activities at the RecPlex.

Compliance with Policies: I agree to abide by all policies developed by the Office of Campus Recreation at NSU, a company of which I have received. The failure to follow any such policy may result in a suspension or cancellation of my RecPlex membership and privilege.

I agree that if any provision of this document is held to be invalid or unenforceable by a court of competent jurisdiction, then the remaining portion shall nevertheless continue in full force and effect to the maximum extent permitted by law.

Agreement
I confirm that I have read this document fully and understand and agree to its contents. I understand that by completing this document that I am COMMITTING TO a RecPlex membership and that a RecPlex staff member will contact me to confirm all details and payment information. I understand that I will need to electronically sign a membership agreement upon my initial visit to the RecPlex.
